En esta l\u00ednea, sus principales objetivos apuntan a contribuir a la toma de decisiones prestando asesor\u00eda jur\u00eddica efectiva que permita al Ministerio de Obras P\u00fablicas resolver situaciones relacionadas con el quehacer institucional; y tramitar la adquisici\u00f3n o regularizaci\u00f3n de terrenos necesarios para las obras de infraestructura p\u00fablica, a trav\u00e9s de un proceso de expropiaci\u00f3n oportuno y eficaz. Durante el periodo de Gobierno 2018-2022, esta Fiscal\u00eda de Obras P\u00fablicas estima pertinente destacar los siguientes logros:\n\nLevantamiento, actualizaci\u00f3n y documentaci\u00f3n de procedimientos internos cr\u00edticos:\n\nUno de los logros durante el periodo fue el levantamiento, actualizaci\u00f3n y documentaci\u00f3n de 35 de sus procedimientos internos, a fin de aumentar la eficiencia en la respuesta a los requerimientos recibidos por el servicio y el fortalecimiento de su gesti\u00f3n interna. Cabe destacar que el servicio al a\u00f1o 2019 no contaba con procedimientos documentados o actualizados respecto a sus procesos de mayor criticidad, por lo que el avance conseguido durante el periodo de Gobierno 2019-2022 ha significado la construcci\u00f3n de cimientos hacia una mejora de la gesti\u00f3n institucional importante.\n\nDado que una de las funciones de la Fiscal\u00eda de Obras P\u00fablicas es asesorar jur\u00eddicamente a las autoridades del MOP, este trabajo ha sido de gran ayuda al momento de enfrentar los distintos requerimientos de clientes internos y externos, como son en los casos de requerimientos de asesor\u00eda jur\u00eddica respecto a documentos administrativos (revisi\u00f3n de liquidaciones y modificaciones de contratos de ejecuci\u00f3n de obras p\u00fablicas, an\u00e1lisis de p\u00f3lizas de garant\u00edas,  entre otros), respecto a procesos disciplinarios (elaboraci\u00f3n de informes de legalidad y tramitaci\u00f3n de sumarios e investigaciones), respecto a tramitaci\u00f3n de expropiaciones de terrenos para la construcci\u00f3n de obra p\u00fablica (elaboraci\u00f3n y\/o actualizaci\u00f3n de estudios de t\u00edtulos, y nombramiento de comisi\u00f3n de peritos tasadores), y respecto a la coordinaci\u00f3n de la defensa judicial de las direcciones del Ministerio de Obras P\u00fablicas. Por otro lado, se documentaron procedimientos vinculados a la gesti\u00f3n interna institucional, velando por el correcto proceso administrativo y uso de los recursos presupuestarios, y el cumplimiento del servicio de sus obligaciones con sus proveedores.\n\nRegularizaci\u00f3n de procedimientos disciplinarios:\n\nDebido a que en el a\u00f1o 2019 exist\u00edan pendientes de tramitaci\u00f3n procesos disciplinarios incoados el a\u00f1o 2014, y con la finalidad de acortar la brecha de seis a\u00f1os, se realiz\u00f3 una planificaci\u00f3n al interior de la Fiscal\u00eda de Obras P\u00fablica, mediante el control y seguimiento de los procesos disciplinarios inconclusos, y as\u00ed dar cumplimiento de los est\u00e1ndares necesarios para conseguir la eficiencia perseguida, cre\u00e1ndose desde el a\u00f1o 2019 y vigente a la fecha; mecanismos de control y reportar\u00eda peri\u00f3dica con \u00e9nfasis en terminar los procesos de arrastre, desde el a\u00f1o 2014 al a\u00f1o 2018, en que se incluye informaci\u00f3n relativa a cada fiscal instructor, analista de fiscalizaci\u00f3n y fiscales regionales, y la cantidad de procesos disciplinarios a su cargo, as\u00ed como un resumen con la informaci\u00f3n sucinta por materia de los procesos. Esta informaci\u00f3n es entregada trimestralmente desde el a\u00f1o 2019 a la fecha, a fin de elaborar los reportes solicitados por el Consejo de Auditor\u00eda General de Gobierno.\n\nDise\u00f1o e implementaci\u00f3n del sistema sumarios ministeriales:\n\nProducto de una auditor\u00eda de la Contralor\u00eda General de la Rep\u00fablica, se estableci\u00f3 la necesidad que el Ministerio de Obras P\u00fablicas contara con un sistema \u00fanico de registro de los procesos disciplinarios, de manera de poder dar informaci\u00f3n fidedigna y confiable, agregando en dicha auditor\u00eda la necesidad que dicho sistema debiera contar con los resguardos necesarios para ser un sistema confiable y reservado, es decir, con pocos administradores, de manera de que la informaci\u00f3n no pudiera ser manipulada. De esta manera, Fiscal\u00eda de Obras P\u00fablicas comenz\u00f3 a trabajar con la Subsecretar\u00eda de Obras P\u00fablicas desde el a\u00f1o 2019 en la creaci\u00f3n de un sistema de sumarios a nivel ministerial,  el que comenz\u00f3 su marcha blanca en el a\u00f1o 2020, para luego implementarse de manera obligatoria a todo el Ministerio, debiendo cada direcci\u00f3n obligatoriamente ingresar al sistema la informaci\u00f3n de los sumarios e investigaciones sumarias que se tramiten, dando cumplimiento al compromiso contra\u00eddo con la Auditor\u00eda Ministerial y con la Contralor\u00eda General de la Rep\u00fablica. La plataforma se encuentra disponible en el sitio web sumario.mop.gob.cl. La Fiscal\u00eda de Obras P\u00fablicas tiene la administraci\u00f3n del sistema y tiene el registro de los procesos disciplinarios que se tramitan en las direcciones del Ministerio de Obras P\u00fablicas, generando reportes peri\u00f3dicos sobre el estado de tramitaci\u00f3n de cada proceso, trabajando adem\u00e1s activamente durante el a\u00f1o 2021 en darle plena operatividad, pobl\u00e1ndolo con los procesos que se fueron incoando en colaboraci\u00f3n con los equipos de las direcciones del Ministerio de Obras P\u00fablicas.\n\nApoyo en la implementaci\u00f3n de las NICSP en el Ministerio de Obras P\u00fablicas:\n\nUno de los desaf\u00edos ministeriales que surgi\u00f3 en el periodo de Gobierno 2018-2021 fue la implementaci\u00f3n de las Normas Internacionales de Contabilidad para el Sector P\u00fablico (NICSP), lo que implic\u00f3 el trabajo coordinado de la Direcci\u00f3n de Contabilidad y Finanzas con los distintos servicios del Ministerio de Obras P\u00fablicas, incluida la Fiscal\u00eda de Obras P\u00fablicas, siendo uno de sus roles principales la revisi\u00f3n de causas civiles y laborales, vigentes y terminadas, al tener que ser considerados en la contabilidad los potenciales pagos involucrados en cada causa, ya sean a favor o en contra al Fisco, de acuerdo a estas nuevas normas de contabilidad. Lo anterior signific\u00f3 un esfuerzo importante, tanto de horas de trabajo como de compromiso por el cumplimiento de los plazos y la cantidad de causas, informando peri\u00f3dicamente entre los a\u00f1os 2019 y 2021 el estado de 3506 causas civiles y 4629 causas laborales (8135 en total entre ambas). Por otro lado y dentro de la tem\u00e1tica de implementaci\u00f3n de las NICSP, la Fiscal\u00eda de Obras P\u00fablicas trabaj\u00f3 arduamente la regularizaci\u00f3n del pago de licencias m\u00e9dicas pendientes de la tramitaci\u00f3n de su resoluci\u00f3n, a fin de regularizar cuentas por cobrar y cuentas por pagar que se encontraban pendientes.\n\nImplementaci\u00f3n de sistema de control de gesti\u00f3n sobre los requerimientos:\n\nA medida que se han ido implementando mejoras en la Fiscal\u00eda de Obras P\u00fablicas, sobre todo en el per\u00edodo de pandemia, se han desarrollado una serie de mecanismos de control, a fin de evitar errores, requerimientos sin contestar y procesos sin tramitaci\u00f3n. Lo anterior se ha logrado mediante la implementaci\u00f3n de un sistema de control de gesti\u00f3n sobre todos los requerimientos de informes legales, estudios, asesor\u00edas y control de legalidad, mediante la generaci\u00f3n de reportes semanales. Lo anterior ha requerido que las jefaturas a cargo de cada requerimiento realicen una revisi\u00f3n peri\u00f3dica de las solicitudes bajo el an\u00e1lisis de su equipo, tomando las medidas correspondientes que se requieran en cada caso particular en que se detecten demoras desmedidas.\n\nFortalecimientos de los equipos de trabajo a nivel regional:\n\nDurante el periodo de Gobierno 2019-2022 se fueron fortaleciendo paulatinamente los equipos legales de las regiones de mayor demanda, a fin de contribuir a una eficiente toma de decisiones, prestando asesor\u00eda jur\u00eddica efectiva que permita al Ministerio de Obras P\u00fablicas dar cumplimiento al Plan de Recuperaci\u00f3n Econ\u00f3mica, apoyando a las \u00e1reas operativas del ministerio en la gesti\u00f3n de su presupuesto, mediante la asesor\u00eda legal oportuna en materias contractuales, expropiatorias, normativas y judiciales. \n\nInformes trimestrales de juicios vigentes:\n\nA contar del a\u00f1o 2020 la Fiscal\u00eda de Obras P\u00fablicas remite trimestralmente un reporte de juicios en tramitaci\u00f3n que dicen relaci\u00f3n con las direcciones del Ministerio de Obras P\u00fablicas. Se incorporan los juicios que se han coordinado en conjunto con cada uno de los servicios y se incluye una observaci\u00f3n en aquellos casos en que se encuentra pendiente alguna gesti\u00f3n, para efectos de que se adopten las medidas necesarias para cumplir con los plazos legales y\/o judiciales establecidos y en definitiva de logre una correcta defensa de los intereses fiscales.  Adem\u00e1s, se informa de aquellas causas que han terminado y si el resultado ha sido favorable o desfavorable para el Servicio. Lo anterior ha significado una mejor sistematizaci\u00f3n de los juicios en tramitaci\u00f3n con las diferentes direcciones y un mejor control sobre los requerimientos pendientes en cada uno.\n\nInformes de liquidaciones de contratos:\n\nCon una periodicidad cuatrimestral, la Fiscal\u00eda de Obras P\u00fablicas ha remitido a la Direcci\u00f3n de Contabilidad y Finanzas un informe con el estado de la cobranza judicial relacionada con liquidaciones de contrato de obra o consultor\u00eda que han arrojado saldo a favor del Fisco y que su cobro debe ser perseguido por el Consejo de Defensa del Estado. Lo anterior implica una sistematizaci\u00f3n de la informaci\u00f3n con que cuenta la Fiscal\u00eda de Obras P\u00fablicas respecto de las referidas liquidaciones de contrato, como tambi\u00e9n un trabajo previo en cuanto a pedir cuenta a las direcciones del Ministerio de Obras P\u00fablicas o al Consejo de Defensa del Estado, y un seguimiento de aquellos casos que se encuentran judicializados.\n\nEficiencia en el pago a proveedores:\n\nA partir del a\u00f1o 2019 se hizo exigible a las instituciones p\u00fablicas que los pagos a los proveedores se efectuaran dentro de los treinta d\u00edas corridos siguientes a la recepci\u00f3n de la factura o del respectivo instrumento tributario de cobro, luego de la promulgaci\u00f3n de la \u201cLey de Pago 30 D\u00edas\u201c. Lo anterior signific\u00f3 un gran desaf\u00edo para el Ministerio de Obras P\u00fablicas, por lo que se comprometi\u00f3 a nivel ministerial un indicador que midi\u00f3 el porcentaje de documentos a pago tramitados por cada uno de los servicios en un plazo no superior a 20 d\u00edas corridos, sobre el cual la Fiscal\u00eda de Obras P\u00fablicas alcanz\u00f3 un resultado promedio de 97% entre los a\u00f1os 2019 y 2021, demostrando su compromiso en dar cumplimiento al pago eficiente a sus proveedores.\n\nBajo nivel de sobregasto:\n\nLa Fiscal\u00eda de Obras P\u00fablicas, al cierre del a\u00f1o 2021, ha alcanzado niveles de sobregasto por debajo el 5%, ya sean en transacciones realizadas v\u00eda Convenio Marco, Compra \u00c1gil, Licitaciones o Trato Directo, lo que demuestra que ha alcanzado una alta eficiencia en el gasto p\u00fablico a nivel del servicio.\n\nCumplimiento de compromisos de gesti\u00f3n institucional: \n\nFinalmente, cabe destacar que la Fiscal\u00eda de Obras P\u00fablicas ha dado cumplimiento a sus compromisos de gesti\u00f3n institucional de manera satisfactoria durante el periodo de Gobierno 2019-2022, procurando siempre a\u00f1o a a\u00f1o aumentar la exigencia sobre la oportunidad de respuesta a los requerimientos que recibe desde sus clientes internos y externos. As\u00ed, durante el periodo el servicio alcanz\u00f3 un cumplimiento promedio de 99,9% sobre sus metas comprometidas en el Programa de Mejoramiento de la Gesti\u00f3n, mientras que logr\u00f3 un 99,4% de cumplimiento promedio en las metas establecidas en sus Convenios de Desempe\u00f1o Colectivo.","estado":"borrador","acta_id":"115","created_at":"2022-01-18 12:29:47","updated_at":"2022-03-03
